Contest Rules and Regulations
1. The Contest
The Hunter-ed.com Hunter Ed Advantage Contest (the “Contest”) starts at 12:01 a.m. EST on September 10, 2014, and ends at 11:59 p.m. EST on December 31, 2014 ("Entry Period"). The Contest shall be subject to these Contest Rules and Regulations (these "Rules") available at http://www.hunter-ed.com/blog/contest-rules-2014/. By entering, all participants agree to be bound by the terms and conditions of these Rules. This Contest is governed by the laws of the State of Texas, and by entering all entrants and winners agree that all claims or disputes relating to or arising from the Contest or these Rules must be resolved exclusively in the federal or state courts in Dallas, Texas.
2. Eligibility
THE CONTEST IS OPEN ONLY TO LEGAL RESIDENTS THE UNITED STATES OF AMERICA WHO HAVE REACHED THE AGE OF 18 (19 YEARS OF AGE IF A RESIDENT OF ALABAMA OR NEBRASKA; 21 YEARS OF AGE IF A RESIDENT OF MISSISSIPPI) OR THE LEGAL AGE OF MAJORITY ACCORDING TO THEIR STATE OF RESIDENCE AS OF THE DATE OF THEIR ENTRY. Employees and contractors of Hunter-ed.com; employees and contractors of its respective advertising and promotional agencies, and partners; and members of their respective immediate families living in the same household are not eligible for the Contest. The Contest is void outside of the United States and where prohibited by law. If a winner is under the age of 18 (19 years of age if a resident of Alabama or Nebraska; 21 years of age if a resident of Mississippi) or the legal age of majority according to their state, one (1) parent or guardian may claim the prize on the winner’s behalf with proof of guardianship acceptable to Hunter-ed.com in its sole discretion. ALL ENTRIES FOR THE CONTEST MUST BE RECEIVED BY 11:59 p.m. EST ON December 31, 2014. Entrants who do not follow these Rules will be disqualified. To enter the Contest, eligible persons must register for an online course at www.Hunter-ed.com for their residing state, pass the course, pay for the course, and obtain their course completion certificate. No purchase necessary. For a no-purchase entry, please submit a 250-word essay on how studying the Hunter-ed.com hunter safety course free online study guide has made you a safer hunter. Label your essay with your full legal name, birth date, mailing address, email address, and telephone number, and mail it to: Kalkomey Enterprises, Inc., ATTN: Hunter Ed Advantage Contest, 14086 Proton Road, Dallas, TX 75244.
3. Entry Form
Kalkomey Enterprises, Inc. (doing business as Hunter-ed.com) and its affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees, representatives, agents, attorneys, spouses and the successors, heirs and assigns of all of the foregoing (collectively, the “Sponsor Parties”) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; congestion, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest; inability to access the website or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; data processing that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any website; printing; administrative or other errors of any kind or any combination thereof. Proof of entering information at the website is not considered proof of delivery or receipt. Illegible, incomplete entries will be disqualified. All entries become the property of Hunter-ed.com and will not be returned. False and/or deceptive entries or acts shall render entrants ineligible. Any information collected by registering to enter the Contest shall be used only in a manner consistent with these Rules and with the Hunter-ed.com online Terms of Use and Privacy Policy.
4. Prize
The Hunter-ed.com Hunter Ed Advantage Contest includes: a chance to win one of 130 prizes including CVA® muzzleloaders (with an approximate retail value of $170 each), BowTech® archery bows (with an approximate retail value of $399 each), Hunter Safety Systems Tree Line Safety System (with an approximate retail value of $40 each), and Bass Pro Shops® gift cards (with an approximate retail value of $25 each). Only those items specifically listed above are included in addition to shipping and handling of prizes. No responsibility is assumed by the Sponsor Parties for cancelled, delayed, or suspended prizes for any reason whatsoever beyond their reasonable control. Other restrictions may apply. The Contest’s prizes, dates and features are subject to change at Hunter-ed.com’s sole discretion. Prize(s) are non-transferable, except at the sole discretion of Hunter-ed.com. All winners are solely responsible for any taxes on their respective individual prizes. An entrant may only win 1 prize during the contest.
5. Winner Selection & Notification
Five (5) entrants per month in the months of September, October, and November 2014 will be randomly selected by Hunter-ed.com from all eligible entries received for that month’s contest giveaway date. The contest giveaway date will be the last day of each participating month. Winners will be notified by telephone and/or email within two weeks of the applicable giveaway date.
The remaining 115 consolation winners and Grand Prize Winner will be randomly selected by Hunter-ed.com from all eligible entries received during the duration of Contest.
Winners may be required to complete, sign and return, prior to receipt of their respective prizes, an affidavit of eligibility, liability release and, where lawful, publicity release.
6. Entries
All entries become the property of the Sponsor Parties who assume no responsibility for lost, stolen, delayed, damaged, or misdirected entries.
7. Personal Information
Information gathered from the online entry form is for the sole use of Hunter-ed.com in connection with the Contest. Personal Information (your name, address, telephone number, and email) will not be passed on to any other organization or group for the purpose of solicitation. No correspondence will be entered into, except with the selected entrants who will be notified by email or telephone. By entering the contest, entrants consent to the use of their name, address (city and state only), likeness (photograph), and statements in any publicity carried out by Hunter-ed.com without compensation or limitation or approval, and may be required to execute affidavits of eligibility and/or a publicity release.
8. Contest Termination
Hunter-ed.com reserves the right to terminate or modify the Contest in any way that it deems to be fair and equitable in the event of an occurrence that may materially affect the proper play of the Contest.
9. Suspension
Subject to paragraph 8, if for any reason this Contest is not capable of running as planned, or if this Contest or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Contest and processing of entries per these Rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Hunter-ed.com's sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Hunter-ed.com reserves the right, at its sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify, or suspend this Contest or any portion thereof. If such cancellation, termination, modification, or suspension occurs, notification will be posted on the Hunter-ed.com website. Any attempt by any person to deliberately damage any website or undermine legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made, Hunter-ed.com reserves the right to disqualify and seek damages from any such individual to the fullest extent permitted by law. In the event of dispute over source of any electronic entry, the entry will be attributed to the authorized account holder of the email account. The "authorized account holder" is deemed the natural person who is assigned to an email address by an Internet access provider, service provider or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide Hunter-ed.com with proof that the potential winner is the authorized account holder of the email address associated with the winning entry and that all eligibility requirements are met.
10. Release
By participating in the Contest, the entrant releases the Sponsor Parties from any and all claims, damages or liabilities arising from or relating to such entrant's participation in the Contest. By accepting a prize, winners agree that the Sponsor Parties shall not be liable for any loss or injury resulting from participation in the Contest, or the acceptance or use of any prize.
11. Transfer and Assignment
No transfer, or assignment, or substitution for cash equivalent of prizes will be allowed except at the sole discretion of Hunter-ed.com. The chances of being selected depend upon the total number of entries received. The contest is subject to all applicable federal, provincial, state, and municipal laws. In the event a prize is unavailable, Hunter-ed.com will use commercially reasonable efforts to substitute another prize of equivalent value.
12. Sponsor
The sponsor of this contest is Kalkomey Enterprises, Inc., doing business as Hunter-ed.com. To obtain the winner's list, available after October 3, 2014, visit www.hunter-ed.com/Advantage. This contest is in no way sponsored, endorsed or administered by Connecticut Valley Arms® (CVA®), BowTech®, Cabela’s® or Bass Pro Shops®.
